Your Legal Rights and Responsibilities
Canada is country where all rules are equal for every person irrespective of their culture, caste, religion, country, sex. It is diverse country where abundance of immigrants lives and develop their career. There are some rules and regulations for international people who are coming in Canada for different reasons such as students, workers. There are various laws authorized by the government, so that they can live in Canada legally. Below I have mentioned multiple rules:
- 1. Immigration rules
- 2. Employment rules
- 3. Tenancy rules
1. Immigration rules: As you travel from one country to other there are various documents you have to clarify, and you have to explain the reason why you are leaving your own country. It should be a valid reason for leaving your home country and proper documentation and rules should be followed to avoid trouble in future.
There are different types of visas guaranteed by the government such as
- ¬ student visa
- ¬ work visa
- ¬ spouse visa
- ¬ tourist visa
Student visa: There are various rules for students to live abroad such as they should have a valid study permit. Whenever they had a valid study permit, they are permitted to study full time and they can do 20 hours work per week.
International Students can only apply to colleges who has DLI (Designated learning institution) number approved by the government. Those institutes have their own rules and regulations for students so that they can feel free to make their career. KPU has Student Rights and Responsibilities Office (SRRO) for students to practice their rights. There are various policies revised by KPU for students:
- ¬ ST7 (Student Conduct Non-Academic): This policy deal with rights and regulations of students and university concerning non-academic conduct of students.
- ¬ SR14 (Sexual Violence and Misconduct): This policy supports the university to establishing the safe and respectful environment for students and faculty working in university.
- ¬ Behavior Intervention Team, Conflict Resolution, Meditation, Restorative Dialogues
Work Visa: Workers who are immigrating from one country for work should have their work permit. And they can work in Canada in any field. There are no restrictions of hours when you are on work permit.
Tourist Visa: There are some people who are very keen for visiting different places and want to explore. Moreover, they want to fulfill their dreams. Tourist visa is for shorter period they cannot work on this visa.
2. Employment rules: Students who are working full time or part time should have a valid SIN Number which is a 9 Digit Number that can be used to get access to all government benefits and tax deductions from earned income in Canada. Those who want to work full time must have the work permit and there is no restriction of number of hours you can work. You can apply work permit on CIC website.
Rights for the foreign workers are:
- Their have equal right to get pay for work they have done.
- They have right to say no if the workplace they feel is not safe for them.
- Nobody can take passport or work permit from you.
- Every detailed information provided it to be kept anonymous.
- Nobody has right to tease based on color, religion, sex.
There are various cases in which students had been deported from international country because they are breaking the rules of that country. Recently Jobandeep Singh had been deported from Canada because he was working more than 20 hours when he was having study permit, sometimes there is conflict between students and this result to death.
3. Tenancy laws: There are various acts that come under Tenancy Laws and regulations to Support and protect rights of both landlord and tenants, so that both are participating properly and fairly in tenancy business. Below there are some acts provided by government to solve the conflicts between landlord and tenant:
- ¬ Residential Tenancy Act: This covers various agreement between landlord and student such as
Rent – This term means that value that is agreed between tenant and land owner.
Security deposit – It means tenant has to pay some amount before lease so that it can be kept as security deposit and they have to properly maintain the property.
Fixed term tenancy – This term means that time period for which landlord is renting the property.
